The labor prosecutors’ office in Bahia announced on Tuesday that they are pursuing 257 million Brazilian reais in damages from BYD, China JinJiang Construction Brazil, and Tecmonta Equipamentos Inteligentes.

This lawsuit arises from an investigation that uncovered the plight of 220 Chinese workers who were rescued from the construction site of BYD’s new factory in Camaçari last year. Prosecutors allege that these workers were lured to Brazil under false pretenses and were issued visas that did not correspond to their actual job roles.

According to the prosecutors’ office, the working conditions were described as “extremely degrading.” The workers were reportedly housed in five settlements managed by BYD, JinJiang, and Tecmonta, where some were forced to sleep on beds without mattresses, with their personal belongings stored alongside their food. The facilities were inadequate, with a severe shortage of bathrooms that were not designated by gender. In one settlement, there was only one toilet available for 31 individuals, compelling workers to wake up at 4 a.m. for personal hygiene before starting their shifts.

In response to the allegations, BYD stated that it has been cooperating with the investigations from the outset and plans to address the case as the inquiry progresses. The company emphasized its commitment to adhering to Brazilian laws and international labor standards. Previously, a spokesperson for BYD had contested reports regarding poor working conditions at the construction site, suggesting that such claims were intended to tarnish the reputation of China and its brands.
