On May 28, the court issued this order after observing that no updates had been shared concerning a significant meeting held on May 30, 2023. During that meeting, the Centre resolved to form four expert subcommittees, consisting of specialists in pathology, biochemistry, hematology, and microbiology from Central Government Hospitals. These subcommittees are tasked with defining Standard Operating Procedures (SoPs) for sample collection, establishing collection centers, and developing a policy for the transport and storage of Covid-19 samples.
While the court recognized that a Contempt Petition might not be applicable due to the decisions made, it expressed concern over the lack of follow-up actions. The court stated, “Even though on first blush, the Contempt Petition may not subsist…the vacuum, if any, of steps taken post the meeting of 30th May 2023, is a serious issue.”
Highlighting the widespread reports of Covid-19 activity in the community, the court stressed the urgency of formalizing protocols and providing a clear status update. “Though the Court is sanguine that steps would have been taken and protocols would have been in place, it is imperative for the respondent to place the same on record,” the court remarked.
The court has instructed Central Government Standing Counsel (CGSC) Monika Arora to ensure that the relevant officers are informed of the order and that a comprehensive status report is submitted within six weeks. The case is scheduled for a follow-up hearing on July 18, 2025.
