The directive highlights a concerning trend where hotel operators exploit these women, effectively running brothels under the guise of legitimate businesses. The order notes that, following such raids, it is often the women who are wrongfully labeled as offenders.

According to the Immoral Traffic (Prevention) Act of 1956, while operating a brothel is illegal, engaging in prostitution in private is not. DGP Srivastava referenced a Supreme Court ruling from the 2010 Budhadev Karmaskar vs. State of West Bengal case, which clarified that voluntary sex work is not a criminal act during police raids on brothels.

The directive aims to ensure that law enforcement personnel do not arrest, punish, or harass sex workers, aligning police practices with legal standards. The Madhya Pradesh Police are now tasked with implementing these guidelines effectively in all cases related to the Immoral Traffic (Prevention) Act.
