The court has directed the civic authority in Mumbai to investigate the construction of a madrasa on land designated for a playground.

The Bombay High Court on Monday directed the Brihanmumbai Municipal Corporation (BMC) to conduct an enquiry into the construction of a madrasa on land that was originally reserved for a school playground in Oshiwara. The direction came from a bench comprising Chief Justice Alok Aradhe and Justice MS Karnik during a hearing on a petition filed by actor Kunickaa Sadanand. Through her NGO, Sadanand adopted the Prateeksha Nagar Municipal School in 2004. She argued that the school, which only runs classes up to Class 4, has a high dropout rate, and her NGO had proposed expanding it to Class 10 in collaboration with the BMC.advertisementSadanand’s plea stated that the land in question belongs to the BMC but has been occupied by the Markazul Ma’Arif Education and Research Centre, which has constructed a madrasa on it. The madrasa, in response, claimed that the land had been allotted to them by the Mumbai Housing and Area Development Authority (MHADA), and that the structure had been regularised. However, Sadanand told the court that she had sought clarification from MHADA and was informed that the land was handed over to the BMC on December 28, 1981, and designated as a playground for the school. She also pointed out that on June 20, 2015, the land was officially demarcated as a playground, yet no action had been taken by the civic authorities to use it as such. She further alleged that the madrasa had not produced any proof to show that the construction had been regularised.advertisementThe bench noted that it could not decide from the courtroom whether the structure was illegal or encroaching upon a playground. “Nobody has a right to encroach on a public space. The action has to be done by the authority. Let them ascertain the nature of the construction. If the structure is illegal, then they can demolish it,” the court observed. The court directed the Assistant Municipal Commissioner (AMC) of the K East ward to conduct a survey of the site, issue notices to the petitioner, the madrasa, and any other concerned parties, and allow them to present relevant documents to support their claims. If the AMC concludes that the structure is illegal, the court directed that the state provide police protection to the BMC to carry out demolition.Concluding the hearing, the bench remarked, “We are sure one of you will be before us again.” in a formal or creative style for better SEO.Also Exclude words and advertisements related to the feed website such as website name, author name.
