The Karnataka High Court recently addressed the state government’s appeal against the Central Administrative Tribunal’s (CAT) decision to overturn the suspension of Additional Commissioner of Police (ACP) Vikash Kumar. This suspension followed a tragic stampede that occurred outside Bengaluru’s Chinnaswamy Stadium on June 4.

During the proceedings, Advocate General (AG) Shashi Kiran Shetty represented the state and informed the court that the Union Government had sanctioned the suspension of Vikash and other Indian Police Service (IPS) officers involved. He argued that there was a clear case of dereliction of duty and requested the court to stay the Tribunal’s order, noting that the suspension was officially enacted on June 5.

The High Court, while deliberating on the case, instructed the state to prepare all pertinent records to justify the necessity of the suspension. The court raised critical questions regarding the nature of the allegations against Vikash, asking whether they constituted mere dereliction of duty or warranted suspension.

In response to the AG’s statement that Vikash had returned to work in uniform, the court reiterated its request for caution, advising against escalating the situation further. Senior Advocate Dhyan Chinnappa, representing Vikash, assured the court that his client would refrain from any actions that could be deemed contemptuous or that might complicate the matter. Chinnappa confirmed, “I am not going to file a contempt petition.”

The High Court noted that while the Tribunal had annulled the suspension, the state had yet to issue a reinstatement order for Vikash. The bench emphasized the need for the state to justify whether the suspension was appropriate or if transferring the officers to different posts would have sufficed.

The AG maintained that the records would substantiate the rationale behind the suspension and reiterated his request for a stay on the Tribunal’s ruling. He also sought a hearing on the matter for the following day, with the understanding that no further actions would be taken in the interim.

The bench acknowledged the assurance from Vikash’s counsel that no precipitative actions would occur until the case is resolved. The proceedings have been adjourned to July 9.
