CCI to investigate IndiGo for flight disruptions and abuse of dominance

**IndiGo Faces CCI Investigation Over Flight Disruptions**

The Competition Commission of India (CCI) has initiated an investigation into complaints regarding flight disruptions experienced by IndiGo, one of India’s leading airlines. The CCI’s announcement came on Thursday, although it did not detail the specific nature of the alleged competition law violation. The complaints primarily concern a potential breach of Section 4 of the Competition Act, which addresses abuse of dominance.

In a statement, the CCI noted, “The Commission has taken cognizance of information filed against IndiGo in light of the recent flight disruptions across various routes in the aviation sector. Following an initial assessment, the Commission has decided to advance the matter in accordance with the provisions of the Competition Act, 2002.”

InterGlobe Aviation Ltd, the parent company of IndiGo, reported to stock exchanges that its operations have returned to normal. The company stated, “Having completely stabilized operations across the network starting December 9, 2025, with over 1,800 flights, IndiGo has been gradually and carefully increasing capacity and will operate more than 2,200 flights today, in line with the revised schedule.”

An IndiGo spokesperson added, “We have been flying to all our 138 operational destinations and maintaining normal on-time performance, as per IndiGo standards. We continue to uphold the integrity of the revised schedule and remain committed to providing consistently reliable service to over 350,000 customers daily.” However, queries sent to InterGlobe Aviation seeking further comments went unanswered.

The disruptions in IndiGo’s operations were attributed to a shortage of eligible crew members for flight operations, following the government’s implementation of new regulations aimed at ensuring pilots receive adequate rest and reducing fatigue. This led to numerous flight delays and cancellations, sparking significant criticism on social media and in Parliament, which ultimately prompted the CCI’s decision to investigate.

Experts have expressed caution regarding the use of antitrust laws to address operational disruptions. Naval Satarawala Chopra, a partner at Shardul Amarchand Mangaldas & Co., remarked, “Competition law is not a catch-all for every service failure. Utilizing abuse of dominance provisions to regulate operational lapses blurs the line between sectoral regulation and antitrust enforcement. The CCI must be careful not to transform competition law into a general service quality regulation, as this could shift its focus from protecting competition to addressing consumer dissatisfaction, potentially stifling innovation and competitive markets.”

As the investigation unfolds, the implications for IndiGo and the broader aviation sector remain to be seen.
