In a recent statement, Harmeet Dhillon, Assistant Attorney General of the U.S. Department of Justice, has responded to new allegations concerning a transgender volleyball player at San Jose State University (SJSU). This follows a report by Fox News Digital on July 31, which detailed claims made by former SJSU volleyball player Brooke Slusser regarding a misconduct investigation involving her former teammate, Blaire Fleming. The allegations suggest that Fleming conspired with an opposing player to intentionally spike Slusser in the face during a match last October.

“The Department of Justice has restored fairness to women’s sports and will continue to pursue those who jeopardize young women through woke gender ideology,” Dhillon stated. “We will utilize every legal resource at our disposal to enforce Title IX and safeguard women’s fundamental right to compete in sports without fear of retaliation from men.”

In November, an investigation by the Mountain West Conference into the initial allegations against Fleming concluded without finding “sufficient evidence.” This investigation was conducted by the law firm Willkie Farr & Gallagher (WFG), which was also retained by the Mountain West to defend against a lawsuit filed by Slusser that included the same allegations against Fleming that WFG ultimately cleared. Public records indicate that WFG attorney Tim Heaphy led the investigation into Fleming’s alleged misconduct. Heaphy previously served as the chief investigative counsel for the U.S. House of Representatives select committee investigating the January 6 Capitol protests.

Slusser shared with Fox News Digital that she had spoken with a teammate who was interviewed during the conference’s investigation into Fleming’s alleged actions. “Based on what I was told, exactly what one of my teammates had seen go on that night — about discussing the scouting report and leaving the net open — was communicated to those lawyers. That should have been sufficient evidence,” Slusser remarked. “People are telling you this happened, and it’s not second-hand information. She was present and heard the conversation between Blaire and [former Colorado State volleyball player] Malaya [Jones]. To me, just from what I know without even having to dig deep into this investigation, there is sufficient evidence, and they were informed of it.”

Fox News Digital has not independently verified whether Slusser’s teammate corroborated the allegations against Fleming during the investigation. None of WFG’s attorneys have been accused of breaching any professional conduct rules.

Dhillon’s comments align with those of other GOP officials who have voiced their concerns regarding the recent developments in this case.
