CBI expected to contest suspension of Kuldeep Sengar’s prison sentence in Unnao rape case

The Central Bureau of Investigation (CBI) is preparing to challenge the Delhi High Court’s order suspending the life sentence of former BJP MLA Kuldeep Singh Sengar in the 2017 Unnao rape case. The probe agency has studied the court’s decision and will file a Special Leave Petition (SLP) before the Supreme Court at the earliest, sources told India Today. The Delhi High Court on Tuesday granted bail to Sengar, suspending his sentence while his appeal is pending.advertisementHowever, the order does not immediately ensure Sengar’s release because he remains in custody for a separate conviction relating to the death of the rape survivor’s father.”The CBI has studied the orders of the Division Bench of the Delhi High Court in the Unnao Rape Case and has decided to file an SLP before the Hon’ble Supreme Court at the earliest against the orders of the High Court granting bail to the accused KD Sengar by suspension of the sentence,” sourced said. The CBI and the survivor’s family had strongly opposed Sengar’s appeal and bail petition in the Delhi High Court.”CBI has filed timely replies and written arguments in this matter. The family of the victim has also opposed the petition, citing safety and threats. CBI will immediately challenge this order,” they added. The agency submitted replies and written arguments, while the survivor’s family cited ongoing safety concerns and threats. However, the High Court set stringent conditions for Sengar’s bail, instructing him not to enter a five-kilometre radius of the victim’s residence and to stay in Delhi during the pendency of his appeal. The court said, “We are suspending the sentence. Personal bond of Rs 15 Lakh with three sureties of like amount. Not to come within 5-km radius of the residence of victim. Directed to stay in Delhi during the pendency of the appeal. Ensure that he is available for completing the remaining part of the sentence if in case he is found guilty”.Further, the court stated, “He is also directed not to threaten victim survivor or the mother, deposit his passport with the trial court, and report to the local police station once a week, every Monday at 10am.” Any breach of these conditions would lead to cancellation of bail. The Unnao survivor described the High Court’s decision to suspend Sengar’s sentence as “kaal (death)” for her family, expressing her intent to approach the Supreme Court. The survivor and her mother were recently removed from a protest in Delhi, where they voiced concerns about Sengar’s bail.advertisementSengar continues to serve a 10-year sentence for his conviction in a separate case involving the conspiracy and custodial death of the victim’s father. The High Court’s suspension of his life sentence in the rape case remains effective only during the pendency of his appeal. The five cases related to the Unnao matter were transferred from Uttar Pradesh to Delhi by the Supreme Court, which instructed that proceedings be completed within 45 days to pro in a formal or creative style for better SEO.Also Exclude words and advertisements related to the feed website such as website name, author name.
