The Delhi High Court has affirmed the probate of the late Davinder Kumar Jain’s will, favoring his wife, Usha Jain. The contested 2004 will names Usha Jain as the sole beneficiary of her husband’s substantial assets, estimated in the hundreds of crores, while excluding their four children.

The legal battle began following DK Jain’s death in 2014, which sparked a dispute among family members. At the time of his passing, Luxor had diversified into 27 closely held companies across various sectors, including stationery, plastics, hospitality, and real estate. This expansion led to a contentious situation between Usha Jain and her children—Priya, Pooja, Payal, and Pankaj Jain.

In May 2014, Sanjay Kalra, the family’s chartered accountant, initiated proceedings in the Delhi High Court to validate the 2004 will, which appointed him as executor and Usha Jain as the sole beneficiary. This prompted Priya Jain, who had lived with her father and was actively involved in the family business, to challenge the will. She alleged that her mother had colluded to seize control of Luxor Group and had unfairly deprived her of her inheritance.

Priya contested the will on several grounds, claiming it was forged and contained significant errors, such as misspellings of her father’s name and the absence of any provisions for his children. She also pointed out that the will was unregistered and utilized a type of paper that was not available at the time, questioning why her mother had exclusive control over it.

On May 27, the Delhi High Court issued a letter of administration regarding the disputed will, confirming the chartered accountant as the executor and Usha Jain as the sole beneficiary. This letter grants the administrator the authority to manage the deceased’s assets, settle debts, and distribute the remaining property according to legal guidelines. The court dismissed a request for a forensic examination of the will.

Priya Jain expressed her dissatisfaction with the ruling, stating that the judgment was fundamentally flawed and should be overturned. She argued that the judge incorrectly shifted the burden of proof regarding the will’s authenticity.
