The justices raised concerns about the state’s intentions, suggesting that the government seemed to be attempting to obscure the cases against Balaji, but judicial intervention had thwarted those efforts.

The bench pointed out the potential bias in prosecuting individuals who may have been coerced into paying bribes for employment, stating, “There is apprehension the public prosecutor will not be able to do justice” when powerful figures are involved. They emphasized that many of those accused might actually be victims of the system rather than perpetrators.

The Court urged the Tamil Nadu government to consider treating those who paid bribes as witnesses instead of accused individuals, warning that prosecuting them could lead to significant delays in the trial process. Senior Advocate Gopal Sankaranarayanan, representing one of the petitioners, shared poignant stories of individuals who had to pawn their jewelry to pay bribes for jobs.

The Supreme Court made it clear that the trial judge cannot dismiss any accused without a proper hearing. Additionally, the Court addressed administrative issues, noting that the state had failed to appear during a previous hearing, and directed that expunging applications be scheduled for August 11.
